Acting Minister Cllr. Nyenati Tuan says both Musa Dean, Edwin Kla Martin, Solicitor General are recused from the matter but SG Cephus still melting with it Who is obstructing Justice at the Ministry of Justice over the indictment involving the Senate Secretary, former National Investment Commission and others who have been indicted by the ground jurors of Montserrado County for the crimes of Economic Sabotage, theft of property, Criminal Conspiracy, Forgery among others.
Defending the letter issued by the Liberia Anti-corruption Commission, Liberia’s Solicitor General said the LACC has dismissed all cases from 2018, 2019 and 2020. SG Cephus Defense came in the wake when this reporter saw a Facebook post from one of the Defendants George Gyude Winser ii stating that he had a very cordial discussion with SG Cephus who apologized for the indictment drawn against he [defendant Winser] and the inconvenience it has done to his reputation.
Defendant Winser face book post further expressed that SG Cephus to he defendant Winser that he was innocent about the scheme and further assured him to withdraw his indictment publicly and appreciate certificate will be made.
The former NIC boss when contacted about his Facebook post, he confirmed it and said he stand and maintained what he had written. When contacted about the Facebook post from defendant Winser that he SG apologized him, told team of Judicial Reporters via mobile phone that the LACC has withdrawn all case from 2018-2020 and more besides, from his own personal opinion he referred to the indictment as corporate dispute which has no legal basis.
Liberia Public Radio has obtained a letter from the Ministry of Justice scored as saying by directives of Cllr. Frank Musa Dean Jr. Minister / Attorney General of Liberia, that he (Cllr. Dean), Cllr. Symah S. Cephus, Solicitor General of Liberia and Montserrado County Attorney Edwin Kla Martin are rescued from the above mentioned case which is pending before the court and their recusal is predicted upon the fact that these individuals represented the private prosecutor in private practice.
Barely a days after he has threatened Criminal Court C clerk Knowles W. Shain for his refusal to gave him copy of the indictment when he has recused him from the matter.
The case involving the Senate Secretary and others are in the hands of Assistant Minister for letigation Ministry of Justice and Cllr. Tiawon Gongloe to prosecute the matter. Surprisingly, the letter written by the Liberia Anti-corruption Commission dismissing the matter was written on the 10 of June 2020 when the indictment of Senate Secretary and others were drawn but held under house for reasons best known to he Cllr. Syrenius Cephus and Cleek.
Assistant Minister Reaction
In reacting to the letter issued by LACC, Assistant Minister for letigation at the Ministry of Justice, Wesseh A. Wesseh said when LACC send investigation findings to the Ministry of Justice, the Ministry has sixty days (60) to indict those accused and if they fail as Ministry to take action or prosecute but this case it didn’t happen and they took action by drawing indictment against the accused therefore, the indictment can’t be withdrawn.
Minister Wesseh added they work within the sixty day and indicted those those accused therefore, the withdrawal of the matter by LACC is not to his knowledge because he one of those who are presenting the Ministry of Justice in this matter.
MOJ Assistant Minister disclosed that the section quoted by the LACC was misinterpreted because they acted within 60 days. LACC in their letter to the Ministry of Justice quoted section part Xi section 11.4(a) of LACC act of 2008 which give the commission the power to prosecute cases directly if MOJ for whatever reasons does not take action to prosecute a case of corruption forwarded to the MOJ by the commission within three months calendar upon receipt of the request to prosecute.
Meanwhile, sheriff of Criminal Court C who went to served the Senate Secretary Indictment and writ of Arrest on him this morning were greeted by Nanborlor Singbeh wife who told them that her husband was not feeling well and he is under self-quarantine.
Those who indicted for allegedly misusing 5M USD meant for crash rock business from a Chez republic investors are senate secretary Nanborlor Singbe, George Wisner former National Investment Commission boss, Othello Z.B. Karr, Karel Soccer, Ales Sranmek, Sherman Longan, Jan Holask, Barry F. Teoquah, Ousman Fofana, Gloria Cain, Sylvester Selvkpoh, Patrick Saah Siaphia, Mulbah Kenneh, Patrick Siaphe and others to be identified.
